Activision Sued over Guitar Hero Gaff

You may have heard about how the Wii version of Guitar Hero shipped promising Dolby sound, but is allegedly mono out of the box? Well Sam Livingston of San Diego has filed a class action lawsuit against the publisher because he believes they misled consumers.
Sure I can see it must be annoying, I can see that on the box it may well say Dolby, but in actual fact it’s mono, but does that truly affect someones life so much they take it to this sort of end?It sometimes seems to me that the law is used now and again to gain monetary wealth, not that I’m suggesting that’s the case here, but Activision have remastered the Wii games and are offering replacements as far as I have read previously.
What do you guys think. The lawsuit is seeking damages, restitution, equitable relief, civil penalties, costs and the expenses of the litigation. With all the news surrounding this, you’d think a lot of people would have known about it, but if you didn’t and you bought the game, would you honestly think of taking them to court because you felt so hard done to over the game sound? I feel hard done to when a game doesn’t feature a playable female character, maybe I should start suing developers for my inability to play a female lead in a lot of games? Ya think?
